Konkurzy a reštrukturalizácie z Obchodného vestníka - Oznámenie č. 38K/9/2013

V súlade s nariadením Rady /ES/ č. 1346/2000 zo dňa 29.05.2000, Vám ako správca úpadcu:                V & S Trade, spol. s r.o., 1. Mája 77, 972 51 Handlová, IČO: 45 652 589 /ďalej len úpadca/, oznamujem, že uznesením Okresného súdu v Trenčíne, sp.zn.: 38K/9/2013 bol vyhlásený konkurz na majetok úpadcu.

According to the Direction of the European Council No. 1346/2000 dated 29th May 2000, as the bankruptcy trustees of the bankrupt V & S Trade, spol. s r.o., 1. Mája 77, 972 51 Handlová, IČO: 45 652 589 /hereinafter only ,, the Bankrupt “/ ,our duty is to inform you that with the resolution of the Discrit Court in Trenčín, No. 38K/9/2013 bankruptcy was declared on the Bankruptś estate.

Toto uznesenie Okresného súdu Trenčín bolo uverejnené v Obchodnom vestníku dňa 05.11.2013. Týmto dňom bol vyhlásený konkurz na majetok úpadcu.

This resolution of the Discrit Court Trenčín was published on 05-th of November 2013. The bankruptcy was declared as of this date.

V zmysle zákona č. 7/2005 Z. z. o konkurze a reštrukturalizácií /ďalej len „ZKR“/ veritelia úpadcu sú povinní v lehote 45 dní od vyhlásenia konkurzu prihlásiť svoje pohľadávky v jednom rovnopise na Okresný súd v Trenčíne, Piaristická 27, 911 80 Trenčín, Slovenská republika, k sp. zn.: 38K/9/2013 a v jednom rovnopise na adresu správcu: Ing. Oľga Šabová, Dolný Šianec 1, 911 01 Trenčín, Slovenská republika. Pre každú pohľadávku musí byť predložená samostatná prihláška. V prihláške sa vždy uvedie meno, priezvisko a bydlisko alebo názov a sídlo veriteľa a úpadcu, právny dôvod vzniku pohľadávky, poradie uspokojenia pohľadávky zo všeobecnej podstaty a suma pohľadávky s rozdelením na istinu a príslušenstvo, a príslušenstvo s rozdelením podľa právneho dôvodu vzniku, prihláška sa podáva na predpísanom tlačive, ktoré musí byť datované a podpísané veriteľom. Vzor tlačiva prihlášky je k dispozícii na internetovej stránke www.justice.gov.sk. Rovnakým spôsobom uplatňujú svoje pohľadávky aj veritelia pohľadávok, ktorých vznik je viazaný na splnenie podmienky, pričom sa uvedie podmienka, od ktorej závisí vznik pohľadávky, a aj veritelia pohľadávok zabezpečených vecným právom, ktorí v prihláške uvedú druh, poradie a právny dôvod vzniku vecného práva spolu s určením majetku, ktorým je zabezpečená a sumu, do ktorej je zabezpečená. Pohľadávka sa uplatňuje v mene euro. K prihláške sa pripájajú listiny preukazujúce údaje uvedené v prihláške. Ak veriteľ nemá na území Slovenskej republiky bydlisko alebo sídlo, alebo organizačnú zložku podniku, v prihláške je povinný uviesť zástupcu na doručovanie písomností, ktorý má bydlisko alebo sídlo na území Slovenskej republiky. Ak veriteľ podáva viacero prihlášok, k prihláškam pripojí aj súhrnný prehľad údajov uvedených v jednotlivých prihláškach. Ak sa prihlasuje nepeňažná pohľadávka, k prihláške sa pripojí aj znalecký posudok určujúci hodnotu nepeňažnej pohľadávky.

According to the Act No. 7/2005 Coll.Bankruptcy and Restructuralization Act / hereinafter only „the BRA“ / the creditors of the Bankrupt have to register their claims in a time period of 45 daysbeginning with the declaration of the bankruptcy in one copy in the District Court Trenčín, Piaristická 27, 911 80 Trenčín, Slovak Republic, to the No. 38K/9/2013 and in one copy to the truste to the adress: Ing. Oľga Šabová, Dolný Šianec 1, 911 01 Trenčín, Slovak Republic. Each claim must be registred separately. The registration has to provide information about the name, surname and the adress of the firm and the seat of the creditor and of the Bankrupt, the legal cause of the claim, rankingof the satisfaction of the claim from the bankrupt´s general estate and the amount of the principal and the interests, the legal cause of the interests, the registration has to be filled in a special registration form, which has to be dated and signed. The registration form can be found on the webside www.justice.gov.sk. Credistors whose claims depend on the fulfillment of certain conditions register their claims in the same way. They also state in the registration form the condition on which the claim is dependent. Credistors with claims secured with securities also fill in the registration form which has to provide information about the object to which security is tied. The claim has to be registred in euro currency. Documents prooving the information provided in the registration form have to be anclosed to the registration form. In case creditor does not have a seat or an address or a branch Office in a Slovak republic representative with an address or a seat in a Slovak republic has to be stated. If the creditor registers more than one claim, a summarization of the registrations has to be added to the registration form. In case a non-financial claim is registered, an expert opinion stating the value of the claim has to be added.

Na prihlášky, ktoré nebudú spĺňať zákonom stanovené podmienky, nebudú podané na predpísanom tlačive, nebudú podpísané a datované, alebo znalecký posudok /nepeňažné pohľadávky sa v konkurze neprihliada. Neprihlásené vecné právo uplynutím lehoty na prihlasovanie pohľadávok zanikne. Správca ani súd nie sú povinní vyzvať veriteľa na doplnenie alebo opravu neúplnej alebo nesprávnej prihlášky.

Registrations that will not fulfill the requirements state by the law or will not registered on the required registration form or will not be signed or dated or an expert opinion / non- financial claim ,will not be considered as claims in the bankruptcy. Non registred security rights lapse after the registration period a lapses. The truste of the Court do not have a duty to notify the creditor to ament or the correct the incorrect or the incomplet registration.

úpadcu.
