Konkurzy a reštrukturalizácie z Obchodného vestníka - Oznámenie č. 2K 65/2013

V súlade s Nariadením Rady (ES) č. 1346/2000 zo dňa 29. 5. 2000 ako správca úpadcu: ELKA a.s., IČO: 35 773 651, sídlo: Kremnické Bane 37, 967 01 Kremnica 35 773 (ďalej len "úpadca"), Vám oznamujem, že uznesením Okresného súdu Banská Bystrica, č. k. 2K/65/2013,  dňa 26.10. 2013 začal konkurz na majetok úpadcu.

According to the Direction of the European Council No. 1346/2000 dated 29th May 2000, as the trustee of bankrupt of the bankrupt ELKA a.s., IČO: 35 773 651 , with seat at: Kremnické Bane 37, 967 01 Kremnica 35 773 (hereinafter referred to as "bankrupt"): our duty is to inform you that with the resolution of the District Court Banská Bystrica No. 2K/65/2013, bankruptcy procedure was declared on the Bankrupt’s estate.

Toto uznesenie Okresného súdu Banská Bystrica bolo zverejnené v Obchodnom vestníku č. 207 dňa 25. 10. 2012. This resolution of the District Court Banská Bystrica was published on 25th of October 2013. The bankruptcy procedure was declared as of this date.

V zmysle zákona č. 7/2005 Z.z. o konkurze a reštrukturalizácii (ďalej len „ZKR“) veritelia úpadcu sú povinní v lehote 45 dní od vyhlásenia konkurzu prihlásiť svoje pohľadávky v jednom rovnopise správcovi na adresu: Ing. Jaroslav Ďaďo, správca, 29.augusta č. 31, 974 01 Banská Bystrica, Slovenská republika.  V prihláške sa vždy uvedie meno, priezvisko a bydlisko alebo názov a sídlo veriteľa a úpadcu, právny dôvod vzniku pohľadávky, poradie uspokojenia pohľadávky zo všeobecnej podstaty a celková suma pohľadávky s rozdelením na istinu a príslušenstvo, a príslušenstvo s rozdelením podľa právneho dôvodu vzniku; musí byť podpísaná veriteľom. Vzor tlačiva prihlášky je k dispozícii na internetovej stránke www.justice.gov.sk.

Rovnakým spôsobom uplatňujú svoje pohľadávky aj veritelia pohľadávok, ktorých vznik je viazaný na splnenie podmienky, pričom sa uvedie podmienka, od ktorej závisí vznik pohľadávky, a aj veritelia pohľadávok zabezpečených vecným právom, ktorí samostatne pre každú pohľadávku v samostatnej prihláške uvedú druh, poradie a právny dôvod vzniku vecného práva spolu s určením majetku, ktorým je zabezpečená, a sumu, do ktorej je zabezpečená. Pohľadávka sa uplatňuje v mene euro. K prihláške sa pripájajú listiny preukazujúce údaje uvedené v prihláške. K prihláške nepeňažnej pohľadávky musí byť pripojený znalecký posudok, inak sa na ňu neprihliada. Ak veriteľ nemá na území Slovenskej republiky bydlisko alebo sídlo alebo organizačnú zložku podniku, v prihláške je povinný uviesť zástupcu na doručovanie písomností, ktorý má bydlisko alebo sídlo na území Slovenskej republiky.

According to the Act No. 7/2005 Coll. Bankruptcy and Restructuring Act (hereinafter only „the BRA“) the creditors of the Bankrupt have to lodge their claims in a time period of 45 days beginning with the declaration of the bankruptcy in one copy to the trustee to the address Ing. Jaroslav Ďaďo, správca, 29.augusta č. 31, 974 01 Banská Bystrica, Slovak Republic. The registration has to provide information about the name, surname and the address of the firm and the seat of the creditor and of the Bankrupt, the legal cause of the claim, ranking of the satisfaction of the claim from the bankrupt’s general estate and the amount of the principal and the interests, the legal cause of the interests; the registration has not to be filled in a special registration form, but has to be signed. Creditors whose claims depend on the fulfillment of certain conditions register their claims in the same way. They also state in the registration form the condition on which the claim is dependent.

Creditors with claims secured with securities also fill in the registration form which has to provide information about the object to which the security is tied. Each secured claim must be registered separately.  The claim has to be registered in Euro currency. Documents proving the information provided in the registration form have to be enclosed to the registration form. In case the creditor does not have a seat or an address or a branch office in the Slovak Republic a representative with an address or a seat in the Slovak Republic has to be stated.

Prihlášky, ktoré neobsahujú niektorú zo základných náležitostí prihlášky stanovené smernicou,   nebudú podpísané, budú zaradené do zoznamu, na základe ktorého súd rozhodne, či sa na ne prihliada. Správca ani súd nie sú povinní vyzvať veriteľa na doplnenie alebo opravu neúplnej alebo nesprávnej prihlášky

Registration that will not fulfill the requirements stated by the direction, or will not be signed will not be considered as claims in bankruptcy procedure. The trustee or the court does not have the duty to notify the creditor to ammend or to correct the incorrect or the incomplete registration. Toto zverejnenie sa vzťahuje k zahraničným veriteľom, ktorých pobyt a sídlo nie je známe z dokumentov úpadcu. This information is designed for foreign creditors, whose place of residence or seat is not obvious from the business documentation of the Bankrupt.

Správca úpadcu so sídlom: Kremnické Bane 37, 967 01 Kremnica 35 773 oznamuje, že dňom uverejnenia tohto oznamu v Obchodnom vestníku je možné nahliadať do správcovského spisu v kancelárii: Ing. Jaroslav Ďaďo, správca, 29.augusta 31, 974 01 Banská Bystrica, a to v pracovných dňoch od 9.00 do 11.30 a od 12.30 do 14.00. Termín nahliadnutia do spisu je vhodné dohodnúť vopred, napr. písomne na uvedenej adrese alebo telefonicky na tel. čísle 048/411 58 69.
