JUDr. Viera Kubicová, správca S 272, so sídlom príslušnej kancelárie správcu Záhradnícka 68, 821 08 Bratislava,  správca dlžníka AVANS s.r.o., so sídlom Holubyho 1, 811 03 Bratislava, IČO: 31 318 967 (ďalej len „Dlžník“), v súlade s Nariadením Rady (ES) č. 2015/848 o insolvenčnom konaní zo dňa 20.5.2015, ako správca dlžníka oznamujem, že Uznesením Okresného súdu Bratislava I, spis. zn.: 27R/2/2019 , zo dňa 27.01.2020 bola povolená reštrukturalizácia dlžníka.

JUDr. Viera Kubicová, S272 seated Záhradnícka 68, 821 08 Bratislava, as trustee of the debtor AVANS s.r.o., Holubyho 1, 811 03 Bratislava , Reg, No.: 31 318 967  (hereinafter only as the “Debtor“), has according to the Direction of the European Council No. 2015/848 on insolvency proceedings of 20th May 2015 the duty to inform you that with the resolution of the District Court Bratislava, No. 27R/2/2019 dated 27th of January 2020 restructuring on the Debtor was permitted.

V zmysle zákona č. 7/2005 Z.z. o konkurze a reštrukturalizácii (ďalej len „ZKR“) veritelia dlžníka sú povinní v lehote 30 dní od povolenia reštrukturalizácie prihlásiť svoje pohľadávky v jednom rovnopise u správcu na adrese JUDr. Viera Kubicová, Záhradnícka 68, 821 08 Bratislava, Slovenská republika. Prihláška musí byť podaná na predpísanom tlačive. V prihláške sa vždy uvedie meno, priezvisko a bydlisko alebo názov a sídlo veriteľa a dlžníka, právny dôvod vzniku pohľadávky, poradie uspokojenia pohľadávky a suma pohľadávky s rozdelením na istinu a príslušenstvo, a príslušenstvo s rozdelením podľa právneho dôvodu vzniku; prihláška musí byť datovaná a podpísaná veriteľom. Rovnakým spôsobom uplatňujú svoje pohľadávky aj veritelia pohľadávok, ktorých vznik je viazaný na splnenie podmienky, pričom sa uvedie podmienka, od ktorej závisí vznik pohľadávky, a aj veritelia pohľadávok zabezpečených vecným právom, ktorí v prihláške uvedú druh, poradie a právny dôvod vzniku zabezpečovacieho práva spolu s určením majetku, ktorým je zabezpečená a sumu, do ktorej je zabezpečená. Pohľadávka sa uplatňuje v mene euro. K prihláške sa pripájajú listiny preukazujúce údaje uvedené v prihláške. Ak veriteľ nemá na území Slovenskej republiky bydlisko alebo sídlo alebo organizačnú zložku podniku, v prihláške je povinný uviesť zástupcu na doručovanie písomností, ktorý má bydlisko alebo sídlo na území Slovenskej republiky.

According to the Act No. 7/2005 Coll. Bankruptcy and Restructuring Act (hereinafter only „the BRA“) the creditors of the debtor have to lodge their claims in a time period of 30 days beginning with the declaration of the restructuring procedure in one copy to the address JUDr. Viera Kubicová, seated Záhradnícka 68, 821 08 Bratislava, Slovak Republic. The lodgment of the claim has to be fulfilled in prescribed form and has to provide information about the name, surname and the domicile or business name and registered office of the creditor and of the debtor, the legal cause of the claim, ranking of the satisfaction of the claim from the debtor’s estate and the amount of the principal and the interests, the legal cause of the interests; the lodgment of claim has to be dated and signed. Creditors whose claims depend on the fulfillment of certain conditions register their claims in the same way. They also state in the registration form the condition on which the claim is dependent. Creditors with claims secured with securities also fill in the registration form which has to provide information about the object to which the security is tied. The claim has to be lodged in currency named as EUR.

Documents proving the information provided in the registration form have to be enclosed to the registration form. In case the creditor does not have a seat or an address or a branch office in the Slovak Republic a representative with an address or a seat in the Slovak Republic has to be stated. In case a non-financial claim is lodged, an expert opinion stating the value of the claim has to be added.

Toto zverejnenie sa vzťahuje k zahraničným veriteľom, ktorých pobyt a sídlo nie je známe dokumentov dlžníka.

This information is designed for foreign creditors, whose place of residence or seat is not obvious from the business documentation of the debtor.
